A company can be held liable for the discriminatory practices of a supervisor. In the case, an HR employee terminated an employee for missing work without permission. The court ruled that the company could be held liable because the HR employee did not conduct even a cursory investigation into the incident to determine whether the supervisor was acting appropriately.
The U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) has issued instructions to federal contractors on criminal background screening of employees. The OFCCP’s directive urges contractors to consider federal antidiscrimination laws before refusing to hire applicants based on the results of criminal background checks.
