Whistleblowers

The Securities and Exchange Commission (SEC) has issued a final rule governing how the whistleblower program created under the Dodd-Frank Act will be administered. The rule encourages whistleblowers to report concerns to their companies before turning to the SEC. Legislation (H.R. 2483) introduced by Rep. Michael Grimm (R-NY) would make it mandatory for employees to first report violations to their employers to receive monetary awards.

A federal court has ruled that an employee may pursue her religious discrimination claim against her employer. The employee argued that she could not follow company policy and receive a flu shot because it was against her religion, veganism. The court is allowing the case to proceed, ruling that the employee should be given the opportunity to prove that veganism meets the requirements of religious belief under discrimination statutes.
